1. Acceptance of Terms
By accessing THE LIST's website, mobile application, or by submitting an application or participating as a member, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the app, site, or apply for membership.
These Terms apply to all visitors, applicants, members, and anyone who interacts with The List.
2. Membership Eligibility
Membership in The List is highly selective, and operates strictly by invitation or online application only.
You must be:
- At least 18 years old
- Able to provide accurate identity information
- Capable of meeting the discretion, conduct, and community standards outlined in our Community Guidelines
The List reserves the exclusive right to accept, decline, suspend, or revoke membership at its sole discretion.
All decisions are final.
3. Application Process
By applying, you agree that:
- You will provide complete and truthful information
- You may be asked to verify your identity or social presence
- You understand that you may be denied or waitlisted, and submission does not guarantee approval
- We may retain your application data to support review, safety, and integrity
We may contact you with follow-up questions or clarifications.
4. Member Conduct
Members must uphold the highest standards of discretion, respect, privacy, and integrity, regardless of their visibility or influence. Here, everyone is equal.
You agree not to:
- Violate our Community Guidelines
- Harass or harm other members
- Share, record, or publicize identities, interactions, or events
- Impersonate others or misrepresent your identity
- Use The Few for commercial solicitation without explicit permission
Violation of these standards will result in immediate removal.
5. Confidentiality & Privacy
The List is a network built on referrals and trust.
Members must treat all interactions, identities, and experiences within the society as strictly confidential.
This includes:
- Screenshots
- Photos
- Recordings
- Posts
- External discussion of members, events, or internal communications
Any breach may result in immediate termination of membership without refund.

6. Prohibited Use
You may not use The List, its website, or its membership spaces for:
- Illegal activities
- Data scraping, mining, or automated access
- Commercial exploitation
- Spamming, phishing, or malicious behavior
- Attempts to breach or bypass security controls
We monitor for unusual or abusive activity to maintain safety and integrity.
7. Intellectual Property
All content on The List’s website — including text, images, branding, graphics, and design — is owned by The List or its licensors and protected under applicable intellectual property laws.
You may not:
- Copy
- Reproduce
- Modify
- Distribute
- Publicly display
any content without prior written permission.
All imagery on THE LIST is used for editorial commentary. If you are a rights holder and wish for an image to be removed or credited differently, contact us.
8. Termination
We may suspend or terminate your access at any time, with or without notice, if:
- You violate these Terms
- You breach confidentiality
- You compromise member safety
- You misuse the platform
- You behave in a manner inconsistent with the standards of The List
Termination decisions are final.
If terminated, you lose all access privileges, and no refunds will be issued for any paid membership period unless required by law.
9. Disclaimers
The List is provided “as is,” without warranties of any kind.
We do not guarantee:
- Member interactions
- Outcomes from membership
- Availability or uptime
- Error-free performance
Your use of the platform is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, The List, its founders, partners, and affiliates are not liable for:
- Indirect, incidental, or consequential damages
- Loss of reputation, opportunities, or data
- Any disputes between members
- Unauthorized access to your information beyond our reasonable control
Our total liability shall not exceed the amount you paid for membership in the previous 12 months, if applicable.
11. Third-Party Services
The List may integrate with third-party platforms (e.g., Instagram) for identity verification or application assessment.
These services have their own terms and privacy policies.
We are not responsible for third-party practices.
12. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles.
13. Changes to Terms
We may update these Terms at any time.
Changes will be posted with the revised “Last updated” date.
Continued use of the platform constitutes acceptance of revised Terms.
14. Mobile (SMS) Communication - THE LIST.
If you opt-in, THE LIST may send you SMS messages at your request from time-to-time, for the purposes of two-factor authenticaion (2FA), account notifications, or to fulfill customer support requests.
b. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
c. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at legal@thelistapp.com.
d. Carriers are not liable for delayed or undelivered messages
e. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive individual messages only as requested. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
